1. Rules
1.1 The regatta will be governed by the rules as defined in the racing rules of sailing 2009-2012.
1.2 The Caribbean Sailing Association (CSA) rating rule and the simplified rating rule, the St.Maarten Multihull Handicap rating rule and the Notice of Race, except when any are altered by these Sailing Instructions, and by these Sailing Instructions.
1.3 RRS Rule 77 (Identification on sails) shall not apply.
1.4 In the event of conflict the English text of the rules and these Sailing Instructions as printed and distributed at registration shall apply, any versions posted on the regatta website are purely informational.

2. Notices to Competitors
2.1
Notices to competitors will be posted on the Official Notice Board located at the Information Booth and/or on a separate notice board as follows:
March 3rd, March 4th and the morning of March 5th:    Sint Maarten Yacht Club, Simpson Bay
March 5th afternoon and the morning of March 6th:     Sint Maarten Yacht Club, Simpson Bay
March 6th afternoon and the morning of March 7th:     Waterfront, Marigot

3. Changes to the Sailing Instructions
3.1 Any change to the Sailing Instructions will be posted by 07.30 on the day it will take effect, except that any change to the schedule will be posted by 21.00 on the day before it will take effect.

4. Signals Ashore
4.1 There will be no signals ashore.

5. Schedule of Races
5.1 The schedule of races and starting times for all classes will be issued at registration and will form part of   these Sailing Instructions.
5.2 The scheduled time for the warning signal for the first race is not before 8:50am.

6. Class Flags and Identification
6.1 A list of class flags and the appropriate coloured flag will be issued to each boat at registration.
6.2 Class flags will be flown from the backstay or, if not possible, from a suitable appendage at the stern of the boat where it shall be clearly visible.
6.3 Identification ‘tie-on’ guardrail bow and stern numbers will be provided, if needed, at registration and shall be clearly displayed on both sides of the forward and aft lifelines of the boat. Entrants that have sail numbers must provide them to the registration office and will not be required to have bow/stern numbers.

7. Courses
7.1 Addendum A to these Sailing Instructions lists the marks to be passed, their order and the side on which each mark is to be left. The diagrams show the courses. The written text prevails over the diagrams.
7.2 While racing all boats shall stay to seaward of all marks and buoys that are part of the fueling station in Cole Bay and their imaginary connecting lines.
7.3  While racing all boats shall stay to seaward of all marks and buoys that mark the extension of the runway at Juliana airport in Maho Bay and their imaginary connecting lines.

8. Marks
8.1   Marks of the course will be orange or yellow inflatable buoys, some of which may display advertising. If a mark goes missing it might be replaced by a small round red buoy.
8.2   The Simpson Bay buoy 01, Mark may be a large yellow and green Heineken Inflatable buoy.

9. The start
9.1   Races will be started in accordance with RRS Rule 26. The warning signal for Race Committee Signal Boat 1 will be Five (5) minutes before the starting signal. The warning signal for Race Committee Signal Boat 2 will be Ten (10) minutes before the starting signal. This changes RRS Rule 26.
9.2   The warning signal of each succeeding class shall be made with or after the starting signal of the preceding class.
9.3   The starting line will be between an orange flag on the Race Committee Signal Boat and an orange or yellow inflatable buoy. The Race Committee Signal Boat may be at either end of the starting line.
9.4   Any boat or buoy attached to the Race Committee Signal Boat shall be considered to be part of the Race Committee Signal Boat.
9.5   Boats whose warning signal has not been made shall avoid the starting area during the starting sequence for other races. A breach of this instruction may be protested by the Race Committee only. This changes RRS Rule 60.1 (a).
9.6   Prior to their warning signal, boats of the Bareboat Class shall not have any part of the headsail hoisted or unfurled when they are within 400 metres (1/4 mile) of the starting line. A breach of this instruction may be protested by the Race Committee only. This changes RRS Rule 60.1 (a).
9.7   A boat starting later than 10 minutes after the last starting signal in that starting sequence will be scored DNS without a hearing. This changes RRS Rule A4 and A5.

10. General Recall
10.1 In the event of a general recall, starts for succeeding classes will be postponed accordingly.

11. The finish
11.1 The finishing line will be between an orange flag on a Race Committee Signal Boat and a nearby orange or yellow inflatable buoy.

12. Penalty System
12.1 Except for breaches of Parts 1 and 2 of the RRS, the International Jury may apply any penalty that they deem equitable. This changes RRS rule 64.1.
12.2 A boat that does not take a penalty in accordance with RRS 44 may accept a 30% scoring penalty before the protest hearing provided there was no damage and the boat did not gain a significant advantage.

13. Time Limit
13.1 The time limit for all classes will be 18.00, except that on Sunday March 7th the time limit will be 16.00.
13.2 Boats failing to finish by the time limit will be scored Did Not Finish without a hearing. This changes RRS Rules 35, A4 and A5.

14. Protests
14.1 Protest forms are available with the protest secretary at the official protest desk.
14.2 For each competitor the protest time limit is two hours after the protesting boat finish time of the last race of the day or 18:30, whichever is earlier.
14.3 On Sunday March 7th protests shall be lodged within 2 hours after the protesting boat finish time or 16.30, whichever is earlier.
14.4 Protests will be heard in approximately the order of receipt, starting as soon as possible. Protest hearings will be notified by a listing on the Official Notice Board. This list will be updated at approximately 30-minute intervals from the receipt of the first protest each day until the list has been marked “Final for  the Day”.
14.5 A system of Arbitration may be used prior to full Jury hearings for matters concerning breaches of RRS Part  2.
14.6 When the official measurer of the regatta is satisfied that there is an error in a boat’s measurement certificate at any time during the regatta, he will notify the Jury which will call a hearing. If the Jury is satisfied that the measurement certificate is in error, the measurer will reissue the certificate and the score for all races in the regatta will be adjusted in accordance with the new measurement certificate. This changes RRS rule 78.3.
14.7 Other than as allowed in 14.6 above, no measurement or rating protest may be lodged after the first day of racing. This changes RRS rule 60.1(a).
14.8 When the Jury sits with a panel of less than 5 members, in accordance with Appendix N 1.4(b) the time limit for the parties to request a full IJ hearing shall be 30 minutes from the time the initial decision is announced.

15. Scoring
15.1 Application of handicaps will be made on a time-on-time system.
15.2 For all classes one race shall be completed to constitute a series.
15.3 When fewer than 75% of the starters in a class finish within the time limit, positions for boats that have not finished may be taken at the last mark at which a rounding was recorded by the Race Committee. A boat so recorded shall not be scored better than or equal to one completing the course.

16. Safety
16.1 All boats shall comply with CSA minimum safety requirements except that Multihulls are exempt from the lifeline requirement.
16.2 No boat shall race with an anchor overhanging the bow or forward crossbeam. However written application for exemption from this requirement may be made to the Jury, which may grant any relief it deems appropriate.
16.3 Any boat retiring shall advise the Race Committee at the earliest opportunity. Failure to do so may, following a hearing, result in disqualification from the regatta or such other penalty as the Jury deems equitable.

17. Equipment and Measurement Checks
17.1 A boat or equipment may be inspected at any time for compliance with the CSA measurement rules, CSA safety requirements and these sailing instructions.

18. Official Boats
18.1 Official boats will be marked with a RC flag.

19. Trash Disposal
19.1 Trash shall not deliberately be thrown overboard.

20. Radio Communication
20.1 Information on radio communication for all classes will be included with the registration package and is considered part of these Sailing Instructions.
20.2 The Race Committee Signal Boat may broadcast the following:
- Time checks 30 and 15 minutes before the first start each day;
- Notification of amendments to the Sailing Instructions and, if the amendment is brief, its text;
- The Abandonment or Postponement of any race;
- The Race Committee Signal Boat leaving the finish line.
20.3 Failure of the Race Committee to make these broadcasts will not be grounds for redress.

21. Use of engines
21.1 Any boat that uses her engine during a race shall submit a written report of the incident, including the time and distance covered and the reasons for using the engine, to the jury within the protest time. The jury may, following a hearing take any action it deems appropriate.

Notice of race 2010

The Sint Maarten Yacht Club takes pleasure in inviting you to compete in the 30th edition of the St.Maarten Heineken Regatta, March 5th to 7th, and the Commodores Cup March 4th, 2010. The organizing authority is the Sint Maarten Yacht Club.

Rules
The event will be governed by the rules as defined in the ISAF Racing Rules of Sailing (2009-2012), which can be found at www.sailing.org, the Sailing Instructions and its attachments, and the CSA safety rules. RRS 52 (manual power) will not apply.

Advertising
Boats may be required to display advertising provided by the organizing authority as permitted by ISAF Regulation 20.4.1. The organizing authority may charge a fee to permit advertising selected by the competitor to be displayed in the area reserved for advertising to the organizing authority (forward 20% of each side of the hull and the forward 20% on each side of the boom, plus a sponsor’s flag or burgee on the backstay).

Eligibility & Entry
The Regatta will be held for the following Classes that may get subdivided:
CSA MONOHULL:                                 CSA Rating Rule
BARE BOAT*:                                         CSA Bareboat Rating Rule. Boats of this class will be restricted to recognized 
                                                                  bareboat fleets acceptable to the race committee. Only equipment provided
                                                                  as standard by the bareboat company will be allowed. No Spinnakers, spinnaker
                                                                  poles, whisker poles or second headsails will be permitted. The bareboat class
                                                                  is only open to vessels from recognized bareboat companies with crews who
                                                                  have no previous affiliation or familiarity with the vessel being sailed, the sails
                                                                  and/or the standard bareboat equipment. This does not apply to familiarity with
                                                                  the type of vessel but only to familiarity with the specific vessel being sailed.
                                                                  Operators of bareboat companies including employees and persons who have
                                                                  previous experience or affiliation with the vessel being sailed, the sails and/or
                                                                  the standard bareboat equipment are restricted from this class. The evaluation
                                                                  of this familiarity or otherwise will be determined by the race committee and
                                                                  there is no appeal or redress possible from their decision.
MULTIHULL:                                          St.Maarten Multihull Handicap System
OPEN CLASS:                                       Simplified CSA Rating Rule (modified each day according to performance).
                                                                  Intended for live-aboard boats and boats without CSA rating certificates.

Boats may enter by sending their entry to the Sint Maarten Yacht Club by fax, mail or E-mail no later than February 24th 2010. Boats may be accepted after this date by paying a late fee of US$50.00. Fees
All Classes:       US$7.00 per foot for CSA yacht club members US$8.00 per foot for non CSA yacht club members
                             The entry fee includes a free water taxi pass for all racing crew members
                             The entry fee for the Commodores Cup is a flat fee of US$65.00 per entry.

The entry fee must be paid no later than at registration. The fee is payable in CASH, ST.MAARTEN CHEQUES, TRAVELERS CHEQUE or VISA/MASTER CARD. Entry Fee is in US Dollars.

Bow/Stern Numbers
All boats are required to register their sail numbers for use in identifying their boat. Bareboats, Open class and any other entrants without sail numbers must carry bow and stern numbers for the purpose of identification. RRS Appendix G (Identification on Sails) shall not apply. A cash deposit of US$100.00 is charged at registration for a set of bow/stern numbers. On Sunday, March 7th, after racing, bow/stern numbers must be returned and the deposit will be refunded. The final date to return bow/stern numbers is June 1st 2010, any numbers returned after this date will not have their deposit refunded.

Schedule of Races
Thursday March 4th Commodores Cup for Spinnaker boats only. Friday March 5th, Saturday March 6th and Sunday March 7th St.Maarten Heineken Regatta for all classes. Spinnaker boats participating in racing on Friday March 5th till Sunday March 7th are not required to participate in the Commodores Cup on Thursday March 4th.

Warning signals for the Commodores Cup will not be before 9:50 am. Warning signals for the St.Maarten Heineken Regatta will not be before 8:50 am each day.

Registration
For all participants registration will be open on Wednesday March 3rd and Thursday March 4th from 11:00am to 5:00pm.

Rating
Each entry in the Monohull class must have a valid 2010 CSA digitally certified rating certificate. Each entry in the Bareboat class must have a valid 2010 CSA Bareboat digitally certified rating certificate. Each entry in the Multihull class must have a completed Multihull rating form attached to their entry form. Each entry in the Open class must have a completed CSA Simplified rating form attached to their entry form. Each entry which fails to comply with these rules will sail with a rating of 2.000.

Courses
The race course for the Commodores Cup on Thursday March 4th will be windward – leeward courses

On Friday March 5th, Saturday March 6th and Sunday March 7th, race courses will be on the waters around the island of St.Maarten/Saint Martin, which may include an around the island race, windward leeward races and point to point races. There will be different length courses for the different classes. Sub divided classes may sail different length courses within the classes. The Sailing Instructions and course details will be available at registration.

International Jury
Decisions of the Jury will be final as provided in RRS 70.5

Scoring
For both the Commodores Cup and the St.Maarten Heineken Regatta the low point system of RRS Appendix A will apply. No scores will be excluded. For all classes one race is required to be completed to constitute a series. The Commodores Cup will be scored as a separate event.

Prizes
For the Commodores Cup on Thursday March 4th.Trophies will be awarded to 1st 2nd and 3rd place in each class. When competing in the St.Maarten Heineken Regatta the following prizes will be awarded: The Principal Cup will be the Cup for the “Most Worthy Performance of the Regatta”, as determined by the Organizing Authority in their sole discretion. The Columbus Cup is for the overall winner of the Bareboat Class; this is the only overall class trophy. Trophies will also be awarded to 1st, 2nd and 3rd place in each class. Every day a “Most Worthy Performance of the Day” Cup will be awarded to the boat that fits this title, in sole discretion of the Organizing Authority. The Around the Island Trophies will be awarded on Sunday to the fastest elapsed timed Spinnaker boat Non-Spinnaker boat, Bareboat and Multihull

Competitors participate in the Commodores Cup and/or the St.Maarten Heineken Regatta entirely at their own risk. See RRS 4, Decision to Race. The organizing authority will not accept any liability for material damage or personal injury or death sustained in conjunction with or prior to, during, or after the regatta.

*The Spirit Of Bareboating: Information For The Bareboat Class
In order to ensure that the bareboat class provides sailors an equal opportunity, the Race Committee has established stringent rules to ensure that genuine bareboaters are protected from parties who attempt to arrange for any form of unfair advantage or the provision of superior equipment.
Competitors in the bareboat class should not have any financial or ownership interests in the particular boat being sailed nor have arranged with the charter company to have any equipment installed that might give them any real or perceived advantage.
The boats from the bareboat companies should be allocated to the entrant on a purely random basis. If by some statistical anomaly an entrant is allocated the same boat for two years in a row, the bareboat charter company shall give written notification to the race committee to inform them of the situation. The Race Committee is dedicated to ensuring an equal and fair opportunity for all competitors in the bareboat class.

In order to insure that all participants are ferried to and from their boats in a timely and comfortable fashion, the Sint Maarten Yacht Club invested in boats over the last few years in order further improve the service this year.




The Water Taxi Pass for each crewmember racing in the Regatta is included in the entry fees and is valid for unlimited use during the official opening hours:
  • Thursday, March 4th : 16:00 - 01:00
  • Friday, Saturday and Sunday: 07:00 to 09:30 and 14:00 to 01:00.
Simply hoist the Blue & Orange SOL flag during the day or use the glow stick which will have changing colors this year, during evening hours (provided by us at registration) when you want to go ashore and one of our comfortable Water Taxi dinghies will come and pick you up.

Three zones, named A, B and C, have been defined for anchorage. The Sol Water Taxi Service will only operate between these zones and a dedicated dock. You will find the area your boat has been assigned to in the last minute information handed out at registration.
 
When it is time to board your boat, especially early in the morning when you are in a rush and bringing in the supplies for the day such as lunch, water and of course the most important of them all sun tan lotion, go to the Sol Water Taxi Service Dock.
 
It is important for you to remember in which zone you are anchored. Remembering other characteristics like the name of your boat, your bow number, etc. will be of great help to the drivers to locate your boat.
 
The people in the Blue & Orange Sol Shirts will do their utmost to take you to and from your boat, before and after a great day’s racing and partying.
 
At rush hour, please stay calm and have confidence in your watertaxi drivers. Please realize that they are not allowed to have the Heinekens you had. They do their best to get you ashore or to your yacht.
 
After official opening hours at night and on Monday morning the 8th of March, a limited number of water taxis may run as part of a private enterprise. The cost thereof is not included in the Water Taxi Pass. The Regatta Organization does not accept any responsibility for any form of water taxi service rendered outside the scheduled times as mentioned above.
